Terms of Use of LUMI AI Factory Dataset-as-a-Service

1. Definitions

For the purposes of these Terms of Use, the following definitions apply:

”Content”
Means the Data Provider’s data that use or interact with the Services.

“Dataset‑as‑a‑Service” or “DaaS”
Means the service operated by LUMI AI Factory that enables Data Providers to publish datasets and related metadata for discovery and use by others.

“Data Provider”
Means any legal entity that publishes or makes available a dataset or a use copy of a dataset through the DaaS.

“Data User”
Means any legal entity or individual that accesses or uses datasets published through the DaaS.

“LUMI-O”
Object storage of LUMI that is used in Dataset-as-a-Service for storing data.

“Metadata”
Means descriptive information about a dataset, including but not limited to title, description, provenance, licensing, access conditions, and update information.

“Use Copy”
Means a copy of data made available solely for use, analysis, or research purposes, not for archiving or long‑term preservation.

2. Scope

These Terms of Use govern the publication of datasets and Metadata by Data Providers through the LUMI AI Factory Dataset‑as‑a‑Service.

Any matters not expressly addressed in these Terms of Use shall be governed by the LUMI AI Factory Terms of Service.

Use of the DaaS is also subject to:

• Applicable LUMI Terms and Policies, including user eligibility and acceptable use requirements;
• The General terms of use for CSC’s services for research applicable to the Fairdata services;
• The Fairdata Terms of Use, including requirements related to Metadata publication and data handling.

By publishing datasets through the DaaS, the Data Provider acknowledges and agrees to comply with all of the above terms and policies. LUMI AI Factory reserves the right to change these Terms of Use.

3. Right to Use

The DaaS is intended solely for sharing Use Copies of datasets for discovery and reuse. The service does not function as a repository for long‑term preservation. The service is not meant for special categories of personal data.

All datasets published through the DaaS are made available for others to use. The Data Provider can define limitations, conditions, or restrictions (for example licensing, access conditions, or use limitations) for the datasets that they publish.

Uploading datasets to LUMI‑O and publishing Metadata via Fairdata services require authentication and compliance with the relevant login, registration, and user eligibility requirements, as defined in the applicable LUMI and Fairdata documentation listed in section 2 of this document.

LUMI AI Factory reserves the right to:

• Curate and decide which datasets are accepted for publication in the DaaS; and
• Reject or remove datasets that do not meet the published dataset selection criteria.

The curation process is done based on the general information of the dataset and its use cases, it does not asses the data itself. LUMI AI Factory disclaims any liability for the data included in the dataset. Further information on dataset selection criteria is published on the LUMI AI Factory webpages and given to the Data Provider as part of the selection process.

The DaaS is provided free of charge for Data Providers whose datasets fulfill the applicable criteria.

4. Responsibilities

4.1 Data Provider Responsibilities

The Data Provider is responsible for:

• The lawful origin, quality, accuracy, and integrity of the data;
• Ensuring that the dataset can be shared and used as described;
• Defining any applicable access conditions, usage limitations, or licensing terms;
• Ensuring compliance with applicable laws, sector‑specific requirements, and national and disciplinary ethical guidelines including but not limited to the Responsible Conduct of Research (TENK) guidelines.

By publishing Metadata, the Data Provider agrees to its release under CC0.

In addition it is required that the Data Provider appoint a designated contact person responsible for access management and for making decisions related to the dataset. The Data Provider is responsible for keeping the contact person information updated. This contact person may also be the person uploading the data.

The Data Users remain responsible for assessing the accuracy, completeness, and suitability of the dataset for their intended purpose and complying with the terms, conditions, and limitations defined by the Data Provider. The LUMI AI Factory is not liable for any usage by the Data Users.

4.2 LUMI AI Factory Responsibilities

LUMI AI Factory is responsible for:

• Operating and maintaining the Dataset‑as‑a‑Service;
• Curating datasets and assessing their eligibility for publication based on the published dataset selection criteria, subject to limitations described in section 3;
• Facilitating, where appropriate, collaboration with Data Providers in the creation and maintenance of Metadata.

Although the LUMI AI Factory endeavors to ensure the best service quality possible, the uninterrupted offering of the DaaS cannot be guaranteed.

5. Obligations and Warranties

The Data Provider warrants that:

• They have the right to share the dataset and Metadata as described;
• The publication of the dataset does not infringe intellectual property rights, privacy rights, or other legal rights of third parties;
• Any necessary consents, permissions, or legal bases for sharing the data have been obtained.

The Data Provider is responsible for the data itself.

LUMI AI Factory makes no warranties regarding datasets or Metadata and assumes no responsibility for agreements made between Data Providers and Data Users.

6. Content

The Data Provider is responsible for ensuring that the Content they store in or transmit through LUMI AI Factory Services complies with all applicable laws and regulations, data policies and these Terms. If the Content includes sensitive or confidential information, the Data Provider is responsible for making sure that the Service used to handle the data complies with the required security.

The Data Provider gives the LUMI AI Factory the right to access Content to secure the accessibility, the quality and the security, which includes, for example, automated monitoring for intrusion detection, taking backups, copying/moving Content, or reproducing faults. This includes editing, enriching, or standardising Metadata to support discoverability, interoperability, and service quality. LUMI AI Factory does not assume responsibility for possible inaccuracies in Metadata that arise when Metadata descriptions are prepared or facilitated in collaboration with Data Providers. At all times, the LUMI AI Factory protects the confidentiality of Content as far as permitted by law.

No ownership rights or intellectual property rights of Content are transferred when using the Services, if not otherwise agreed. Data Providers agree that all Metadata published via the DaaS is made available under the CC0 (Public Domain Dedication) licence.

LUMI AI Factory reserves the right to publish dataset Metadata in other services and platforms, including but not limited to European or international aggregating services, to increase visibility and reuse.

Please note that no backups are taken of the Content. No guarantee is given for restoring any Content and disclaims any liability for files lost for any reason, unless otherwise agreed.

7. Data Protection and Information Security

In relation to User Accounts and information related to the User’s usage of the Services as well as the Data Provider’s representatives, the LUMI AI Factory acts as the controller and processes personal data as described in the privacy notice https://lumi-ai-factory.eu/privacy/.

If Data Provider Content contains personal data or special categories of personal data, the Data Provider has to ensure that the service intended to process the data complies with the security level required for this type of data.

In such case, the Data Provider commits to take care of the Data Controller’s responsibilities as described in the applicable data protection legislation. LUMI AI Factory then acts as a Processor of personal data. The Data Provider and LUMI AI Factory will execute LUMI AI Factory’s Data Protection Agreement and will execute a description of processing activities which together govern such processing activities.

LUMI AI Factory offers Services in accordance with the service descriptions and these Terms of Service for the Data Provider to process their Data Provider Content on their own account. 

8. Deletion of Content and Termination of Services

The relevance of each dataset published through the DaaS is evaluated annually. The evaluation is based on relevance for AI development as defined in the dataset selection criteria published on the LUMI AI Factory webpages

If a dataset is deemed to no longer be relevant for AI development:

• LUMI AI Factory reserves the right to delete the Metadata and any associated Use Copy stored in LUMI‑O;
• The Data Provider will be notified at least one (1) month in advance of such removal.

LUMI AI Factory may suspend or terminate dataset publication immediately if required by law, policy, or in the event of misuse, security risks, or material breaches of these Terms of Use.

Termination of publication does not affect any separate agreements made directly between Data Providers and Data Users.

9. Changes to the Terms of Use

The LUMI AI Factory reserves the right to change these Terms of Service from time to time by notifying the Data Provider at least two weeks in advance of the amendment becoming effective. If the Data Provider continues to use the Services after the stated effective date of the amended Terms, the Data Provider is deemed to have accepted the amendment.
